Ascend Marketing Terms of Service

Welcome to Ascend Marketing (“Ascend,” “we,” “our,” or “us”). By purchasing or engaging in our digital services—including Website Builds, Website Support Plans, Growth Credits, Accelerator Credits, and related products—you agree to the following Terms of Service (“Terms”). Please review them carefully before placing an order.
1. Scope of Services
Ascend Marketing provides digital marketing, website design, support, and consulting services. All offerings are considered digital services and begin promptly after purchase. Because work often commences immediately, all sales are subject to our Refund Policy.
2. Month-to-Month & Subscription Services
Website Support Plans and other recurring services are billed on a month-to-month basis unless otherwise stated. Plans automatically renew each month until canceled.
Termination Notice
Either party may terminate a month-to-month or subscription service by providing a 14-day written notice. Any active projects or billed work completed prior to termination remain payable in full.
3. Deposits
Deposits secure a client’s project slot and are applied toward the total project cost. Deposits become non-refundable after 24 hours from payment. Work does not begin until a deposit is received. Ascend retains ownership of all creative work and materials until the account balance is paid in full.
4. Client Responsibilities
Clients must provide timely access, materials, and approvals necessary for project completion—including, but not limited to, Shopify access, domain credentials, images, and written content. Delays in providing materials or approvals may impact timelines and deliverables.
5. Ownership & Deliverables
Ascend Marketing retains full ownership of all creative assets, design files, and development work until the client’s account balance is paid in full. Upon full payment, ownership of the final deliverables is transferred to the client. Any unpaid balances may result in suspension of services or withholding of deliverables.
6. Payments & Refunds
All payments are due as stated in your invoice or order confirmation. Refunds are governed exclusively by the Ascend Marketing Refund Policy. After 24 hours, payments are final and non-refundable, except as outlined in that policy.
7. Growth Credits & Accelerator Credits
Credits are time-based or value-based digital service tokens that can be applied toward approved Ascend Marketing services. Credits hold no cash value and are non-transferable. Once applied, credit-based services follow the same terms as all other Ascend digital services.
8. Limitation of Liability
Ascend Marketing is not liable for any indirect, incidental, or consequential damages, including but not limited to loss of revenue, data, or business opportunities arising from the use or inability to use our services. Our total liability under any agreement shall not exceed the amount paid by the client for the specific service rendered.
9. Confidentiality
Both parties agree to maintain confidentiality of all proprietary and client information obtained during the course of the project. Ascend may showcase completed work in portfolios or marketing materials only after launch or with client approval.
10. Termination & Suspension
Ascend Marketing reserves the right to suspend or terminate service at any time for non-payment, breach of these Terms, or inappropriate client conduct. All outstanding balances remain due immediately upon termination.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States. Any disputes shall be resolved exclusively in the courts of Atlanta, Fulton County, Georgia.
12. Policy Updates
Ascend Marketing reserves the right to update these Terms of Service as our business evolves. The most current version will always be available on this page and identified by the “Last Updated” date above.
